Streszczenie

Niniejszy artykuł ma na celu zestawienie narzędzi interpretacyjnych stosowanych w nauce interpretacji Pisma Świętego w Kościele katolickim ze sposobami wykorzystywanymi w wykładni prawa pozytywnego. Poczynione rozważania ukazują, że interpretacja Biblii i wykładnia prawa, pomimo pozornie dalece idącej odmienności, są w wielu miejscach podobne, a nawet tożsame. Jest tak, ponieważ egzegeci świętych Pism oraz prawnicy niezmiernie często wykorzystują zasady hermeneutyczne oparte na podobnych, wręcz jednakowych założeniach. Wszystkie narzędzia i sposoby, które mogą nam przybliżyć właściwe znaczenie tekstu są pożądane. Pozwala to uznać, że sposób, w jaki tekst Biblii jest interpretowany nie tylko może utwierdzić naukę prawa w jej dotychczasowych intuicjach, ale może ponadto rzucić nowe światło na to, jak prawo może być interpretowane. Interpretacja stanowi zjawisko o charakterze uniwersalnym – zawsze polega ona na ustalaniu intencji autora tekstu. Różnica pomiędzy interpretacją zachodzącą wobec tekstów z różnych dziedzin sprowadza się do użytych w tymże procesie narzędzi. Każdy sposób ustalania intencji powinien być rozważony, skoro na szali leży odczytanie tekstu w sposób prawidłowy.

Instruments for the identification of meaning in secular law and Holy Scripture

Summary

This article aims to compare the interpretative instruments used in the interpretation of the Holy Scripture in the Catholic Church with the methods employed in the interpretation of positive law. The considerations presented demonstrate that, despite their seemingly vast differences, biblical exegesis and legal interpretation are at points similar or even identical. It is because interpreters of sacred texts and legal scholars very often apply hermeneutical principles based on comparable, if not equivalent, assumptions. All tools and methods that can help us uncover the proper meaning of a text are desirable. This allows us to conclude that the way biblical texts are interpreted can not only reinforce legal scholarship in its existing intuitions but may also shed new light on how the law can be interpreted. Interpretation is a universal phenomenon—it always involves determining the author’s intention. The difference between interpreting texts from various fields comes down to the tools used in the process. Every method of discerning intention should be considered, given what is at stake: a correct reading of the text.
