Streszczenie
Trybunał Konstytucyjny w wyroku z 27 listopada 2024 r., U 10/24, stwierdził, że skoro rozporządzenie w sprawie warunków i sposobu organizowania nauki religii w publicznych przedszkolach i szkołach ma zostać wydane w porozumieniu ze związkami religijnymi, to niedopuszczalna jest jego nowelizacja w przypadku sprzeciwu zainteresowanych związków religijnych. Niezależnie od konsekwencji w obszarze ram prawnych organizowania nauki religii w szkole, Trybunał Konstytucyjny w tym wyroku dokonał uelastycznienia zasad konstrukcyjnych systemu źródeł prawa powszechnie obowiązującego w aspekcie podmiotowym, biorąc pod uwagę status prawny związków religijnych wynikający z art. 25 Konstytucji RP.

A commentary on the judgment of the Constitutional Tribunal on 27 January 2024, U 10/24 (the procedure for amending the regulation on religious education)
Summary
The Constitutional Tribunal in its judgment of 27 November 2024, U 10/24, stated that since the regulation on the terms and ways of organising religion classes in public schools and kindergartens shall be issued in agreement with religious denominations, its amendment is inadmissible in case of an objection by the interested religious denominations. Regardless of the consequences in the area of the legal framework for organizing religious education in schools, in this judgment the Constitutional Tribunal made the construction principles of the system of sources of universally binding law more flexible in the subjective aspect, taking into account the legal status of religious associations arising from Article 25 of the Constitution of the Republic of Poland.
