Streszczenie
Współcześnie uznaje się, że prawa człowieka wynikają z przyrodzonej godności człowieka. Rozwój ideałów związanych z międzynarodowo chronionymi prawami człowieka sprzyjał refleksji dotyczącej humanitaryzacji karania, a tym samym obejmował postulat eliminacji kary śmierci z systemów prawnych poszczególnych państw. Artykuł opisuje problematykę kary śmierci w kontekście pracy Funkcjonariusza Służby Więziennej. W pracy ujęto zarówno rys historyczny jak i współczesne standardy ochrony praw człowieka. Artykuł wzbogaca m.in. stanowisko św. Jana Pawła II dotyczące kary śmierci oraz orzecznictwo strasburskie. Podkreślona została rola Służby Więziennej, która działa w oparciu o zasady poszanowania godności oraz humanitaryzmu. Opisane zostały również argumenty przeciwko stosowaniu kary głównej oraz refleksje dotyczące absolutnego charakteru stosowania tejże kary. Z perspektywy praw człowieka jest to kara okrutna, na którą nie ma miejsca we współczesnych systemach prawnych. Prawa człowieka uwrażliwiają. W toku edukacji uświadamiają, że bezwzględny, brutalny odwet nie jest najlepszym rozwiązaniem polityki karnej. Widać to znakomicie na przykładzie edukacji związanej z tematyką kary śmierci. Pod swoistym „naporem argumentów”, faktów, wyników badań nauki, doświadczeń doktryny – wielokrotnie mamy do czynienia ze zmianą stanowiska z retencjonistycznego na abolicjonistyczne. Analizowana grupa zawodowa, charakteryzuje się swoistym umiłowaniem do wartości, które są zbieżne z ideałami, jakie odnaleźć możemy wśród norm praw człowieka. Aczkolwiek konieczne jest dalsze promowanie i edukacja praw człowieka, w tym również w kwestii tematyki dotyczącej kary śmierci.

The elimination of the Heath penalty as the triumph of human rights. Reflections for officers of the Prison Service
Summary
It is recognized today that human rights ensue from the inherent dignity of the human person. The development of the ideals related to the in ternationally protected human rights was conducive to the reflection on the humanitarization of punishment and therefore included the demand to eliminate the death penalty from the legal systems of individual nations. The paper describes the problem of the death penalty in the context of the work of a Prison Service Officer. It includes both the historical background and the modern standard of human rights protection. The paper is supported, among other things, with the position of St. John Paul II on the death penalty and the Strasbourg case-law. An emphasis has been put on the role of the Prison Service, which operates on the principles of respect for human dignity and humanitarianism. The arguments against the use of capital punishment were also described, together with reflections on the absolute nature of the use of such punishment. From the perspective of human rights, it is a cruel punishment for which has no place in contemporary legal systems. Human rights are sensitizing. In the course of education, they make us realize that a brutal and ruthless retribution is not the best penal policy solution. It is perfectly illustrated by the example of education related to the issue of capital punishment. Many a time – under the pressure of arguments, facts, results of scientific studies, and experiences of doctrine – the retentionist position is replaced with the abolitionist one. The analyzed professional group is characterized by its love of the values convergent with the ideals one may find among the norms of human rights. Nonetheless, further promotion and education in human rights is necessary, also with regard to the issue of the death penalty.
