Transgender Persons Deprived of Liberty in Polish Penitentiary Practice – Reflections against the Background of the 2023 Barczewo Case

Summary

The placement of inmates in correctional facilities is carried out strictly according to sex categories. Women are housed separately from men. Meanwhile, public human rights bodies and non-governmental organizations are calling for transgender individuals to be placed in facilities in accordance with their gender identity rather than their biological sex, even if they have not formally changed their gender marker. The article discusses the Barczewo case (concerning the individual W.W.), the legal grounds for modifying prison policies toward transgender individuals, high-profile cases from other countries involving the transfer of biological males to women’s facilities, the legislation of the state of California as an example of highly progressive prison policies toward transgender individuals, followed by the problems revealed in connection with transferring biological males to women’s facilities, and the overlooked perspective in designing these policies—namely, the safety and comfort of incarcerated women.
